Evidently my wife (at the time) filed her taxes separatly in 2004. I was working overseas and she always did the taxes. This was at the beginning of our separation, and I didn't think about it. I just got a letter last week from the IRS saying I owed 11,000 in taxes for that year and with interest, it's now 23,000.

Not sure what's going to happen, I've already emptied my bank account. The bank manager said the IRS will see my withdrawal because of the amount. Yes, I am going to call the IRS and see what I need to do, my main concern is traveling overseas. I'm talking with someone about an installation in China. The other thing is, my passport just expired and I need to renew it, but with the IRS involved now, I'm worried that will screw things up.

I've been detained at customs a couple of times, and I'm sure it's because I get money wired to my personal account from China and Egypt.

Don't forget after the IRS is finished with you the State will be next in line to get their cut. You should call one of those IRS Tax Debt consultation firms. Or get on one of the IRS payment plans if one of those firms can't help. IRS can put a Tax Levy on you which they can put legal seizure of your property to satisfy the IRS tax debt. They can put Wage garnishment, Bank levy into the picture.

there werent state taxes in Fl. I still have issues with paying taxes to the states when I was was working and living in China. I have no property for them to sieze, my ex took it all and I had to sell all of my assets. [Roll Eyes]

As far as the tax levy, thats why I took my money out of the bank.

I suggest you contact the IRS Taxpayer Advocate http://www.irs.gov/advocate/ . Yes, they work for the government but they really are there to help you; my mother had some tax problems and they helped her out quite a bit.

Also, if I am reading your original post right, because of your ex you didn't pay any federal income taxes in 2004 (you thought she filed for the both of you jointly but she filed separately). If that is the case you're going to have to reconcile yourself to paying SOME taxes to the IRS; no one like paying taxes but if nobody did we wouldn't have a very functional country after all. The IRS number of $11,000 is probably high balling what you owe by quite a bit though; I'm guessing they're basing it off your reported income minus a standard deduction. The fact that you were traveling extensively is a clue that you probably have quite a few deductions to claim if you itemize and can probably bring that tax burden down significantly. With the help of the tax advocate and probably an attorney you can probably get most of the penalty dropped too and set up some sort of payment plan.

Also, I'd talk to a lawyer about the fact that your divorce proceedings/decree didn't take into consideration that you actually should've had total assets than was used for it, since you would've already owed the IRS money back then. You might be able to argue for a reduction in alimony or something.

I've got an accountant looking at it and my divorce lawyer is checking into the records from my divorce. My decree said that we had to file jointly that year. I'm not worried about the taxes, that will get worked out. I was just bitching about my ex [uhoh] I was arguing with her about me getting the kids for the end of the summer. she won.

Rick, I don't know what all I signed that year. When we moved to FL, my ex got a job at an accountants office. All of our taxes were filed by them, I don't think I ever signed a return.

Now, my accountant does them and I only get a letter from the IRS stating that my refund was deposited into my ex's bank.

Get some good attorneys and maybe you can stick it to her for once. It would serve her right for being so greedy in the first place. What goes around....

Dude.... Just move to China for 7 years. Problem solved! When our economy tanks for a second time sometime in the next few months things are going to be REALLY BAD here so China may actually be a BETTER place to be! Sad but very true!

Actually you are best off to hire a tax attorney as Louis said OR one of those Tax Places to barter with the IRS for you and get it reduced. Some of those places actually employ ex IRS people! You will still have to pay both the IRS and the State and the Tax PLace but it is usually far far less then if you just paid what you owed. The exact same thing happened to me when I moved to SLC. Ex-Wife filed seperately and I didn't know that... but neither the IRS nor the State of Illinois caught it and the statute of limitations passed before even I realized it, so I was off the hook. I noticed the discrepancy when I was shredding old 10 year old documents that I no longer wanted to store. Sometimes things just work out right...

So today, I get an e-mail from the ex saying my daughter needs braces. $5000 bucks! I wouldn't mind, if I could see her front teeth more than twice a year.

Don't get me wrong, I do anything for my kids, it's just how the ex tells it to me. I got an e-mail yesterday from my ex ( I told her not to call me a few years ago because we always ended up yelling). She said she is engaged and gave me her wedding date (all in big print) like I give a shit, then in small print in the next paragraph she asked how I was going to pay for the braces for our daughter.

If I didn't love my kids so much, I'd still be in China.

Were you legally separated before December 31st of the tax year? For tax purpose you are considered married if you were married as of December 31st of that tax year. If your divorced was finalized OR you were LEGALLY separated before December 31st of that year you cannot file a joint return; you must file as single or head of household.

If this is what happened one would think you're divorce lawyer should have given you a heads up on this....

My dad is a judge and looked everything over before I signed the decree. It states that we file jointly for that year, and then the following years we each claim 1 of the kids.

Bottom of page 14, top of page 15. Your dad might be a judge and I might only be a student in an Income Tax class but I'm pretty sure the IRS won't let you file as Married Filing Joint for the year you were legally separated and/or your divorce was finalized.

Edit: You can certainly change a lot of things in a divorce decree, who can claim a dependent exemption being one of them. I don't think you can change what filing status you are allowed to take though; the rules on that are pretty clear.

Dustin, Separated in 2005, divorced in 2006. This IRS problem is from 2004, the year I was working my ass off and she didn't feel the need to get a job. She even put the kids in day care and afterschool care. I guess she didn't want to be interrupted during her soaps.

Oh well, I still get to pay her and her fiance every week (which i do) and I get to claim it on my taxes. Oh yeah,,,,the IRS sends my refund check directly to her. [fu]

Well, I Think my ex got married this weekend. I've met her new husband last time I got the kids and he seems like a very nice guy. I wanted to warn him, but couldn't get him alone.

Now I need to rant: You'll read the (short) story of Rick.

Before I started dating my ex, I owned both a Porsche and BMW (yes I'm a car guy) parked in the driveway of my own house. She had an old Cavalier. I'm not sure how it happened but after we married the Porsche and BMW went away and I was driving her old car and we bought a newer BMW for her? Then I had to buy a better house, which made us living paycheck to paycheck.

It just sucks that I have to still pay her over 1K a month, I rarely see the kids, and she is living in a very nice house in a gated community in FL, and I am stuck back home living with the parents. I've worked odd jobs here and I get a paycheck showing I worked 40 hours and after support is taken out, my check is for $0.00

I'm working on a deal with my friends in China for a new amusement park. I think I may just relocate there.

Rant off:

I'm not asking for sympathy, just needed to get some of my thoughts out.

I think child support is part of that monthly tally.

I've heard lots of horror stories like this, as well as seen my younger brother go through a couple of bad marriages. That has given me the incentive to never be in any rush to get married. We learn from our mistakes? To hell with that! I like learning from the mistakes of others! It's a lot less costly and painful.

I'm not opposed to getting married at some point. But I think I'm probably getting a little old and set in my ways to be worth a shit at dealing with it.

It's only child support, luckily alimony was never brought up. One of my best friends gets alimony and she said she won't get married because she loses that payment. A few years ago she bought a home in a new neighborhood with her boyfriend. They live just like an average married couple, but she still takes that payment.

What I don't understand is why does the guy always suffer? Luckily my attorney in Evansville was good enough so I didn't have to pay her attorney fees here (50k), but I still had to pay both mine and hers fees in FL. This case cost close to 100k in fees, and I spent time in jail for falling behind in the beginning ($400 a week), all for about 12k in back child support that I was making payments on. I'll be making payments well after the kids turn 18.

There's a saying that goes: "hindsight is always 20-20." It's very difficult to have an accurate idea where a relationship or marriage will go in the long run. Starting out you may think you're dating someone who is just right for you and she's genuinely passionate toward you. That passion may even last for years and seem rock solid. But people can fall out of love just as fast as they fall in love.

Anyone who has been in the dating game long enough has gone through the experience of being blind-sided by a sudden relationship crash. You think you really know your significant other. But then the shit happens and you feel like you never knew this person at all. When someone has experienced that crap multiple times raising the stakes with marriage doesn't seem like such a great idea. I understand you shouldn't make a new significant other pay for what others did to you previously, but the situation is still pretty scary and uncertain at best.

I've been through some very painful break-ups but thankfully I have never been divorced.

I was told I had to be a member of some sort of club to order a beer at any resteraunt, later I bought a 6 pack at a State owned liquor store, I was told that it was watered down. Since I brought up my cars that I had and lost when I met my wife, I figured I would mention the ones I lost during the divorce. She took the Sport trac, which I didn't contest because she also was taking the kids. I had a late 80's Audi GT Coupe in storage that I just left. It needed a little engine work that would probably cost more than the value of the car. I had a 97 Jeep Wrangler that I had made a lot of changes to, my beach car. Neoprene seats, oversized tires, bikini top year round in FL, plus a lot of other details to make it a "looker".

My daily driver was this.

I gave the Jeep to the bank and had to sell the Vette. Some guy got a great deal, it was like the stories you hear about someone buying an exotic car for next to nothing. I knew my ex was expecting the check and I had to take it to my attorney so he could turn it over to hers. I sold it for $2500. I'm a Vette guy and loved that car, I washed it every morning before work, the neighbors probably thought I was crazy because they would hear the leaf blower early in the morning as I was blowing water out of the trim and tail lights.

IMHO the concepts behind divorce law and its judgments typically against men needs to be seriously re-thought. The situation is so much more complicated than it used to be and it is pretty easy for some women to game the system.

My brother has raised his daughter, Janice nearly all her life. The only exception has been the last couple years with her living in Colorado with my parents. There were too many bad influences in the Atlanta school system for Janice to stay there. You know how much child support dollars my brother has got for all those years of being a single parent? ZERO. But I guess that's okay since he is a man.

This issue, and the more horrible issue of unchecked health care cost inflation, is literally going to price the idyllic "American Family" completely out of existence.

I have little if any desire to get married for all the horrible financial risks divorce involves. It doesn't matter if I want to keep the marriage going. If the lady decides she wants to be single again and sow her wild oats I'm going to be taken to the poor house anyway! I personally know guys who have been screwed over like this. It only takes one person not wanting to be married to make a marriage fail. Most attorneys will freely tell anyone not to get married if they can help it.

And then consider the bone crushing costs of having kids these days. The medical bills are pervertedly appalling. Stack on costs of early childhood development, day care and all of the other stuff that goes along with it. Throw in a divorce and you'll have a financial disaster in the making for anyone not rich. Even some rich people get wiped out finanically from divorce too.

The 2010 US Census states that White and Black Americans have had the lowest percentage of population growth over the last 10 years since the Great Depression. The biggest area of population growth in the US is by way of immigration and population growth within Hispanic and Asian minority groups.

Basically us stupid "honkeys" are on a path of pricing ourselves into a small minority. I know I'm not breeding with anyone!

I think quite a few health care costs are literally obscene. It takes people pretty vacant of morals to willingly devastate the finances of patients in order to make health care an "asset class." The industry is set up in a massive circle jerk where hospital corporations, insurance companies, drug companies, trial law firms and other players in the game have a convenient scape goat to blame for their price gouging. The patient is stuck in the middle of this circle jerk getting bukkaked with stupid.

Lots of regular Americans are in an indirect way guilty participants in this nonsense since many have big parts of their retirement funds invested in health care related stocks. The American people also don't want to bring anything to the table so to speak when it comes to finding ways to reduce these skyrocketing costs. The United States is the fattest nation on the planet. 70% of patients in hospitals for life threatening conditions are there with conditions they could have prevented.

Manny, Forget the material things, the worst thing I lost were my kids. When we split, she packed up everything that would fit in the Sport trac and moved to Florida from Omaha. She has no family there, she just liked living there. I ended up back in Indiana. I get the kids either on or after Christmas, every other spring break, and one month of the summer. I could see them on weekends, but it is an 850 mile drive one way. When I pick them up it is 1 day to drive there, 1 day to drive them back to Indiana, then the same when I take them back. It costs at least a thousand bucks just in traveling expenses after the gas, food and lodging are added up. Not to mention the 3400 miles of wear on the car. The Rick SAGA continues. My ex remarried earlier this year and a couple of months ago left her "new" husband. When she was getting married, I was genuinely happy for her. I was thinking stability for the kids.

She packed everything up and took the kids and moved to her parents million dollar house on the Chesapeak in Maryland. Now my kids have to adapt to a whole new situation, friends, school, etc....

I'm left to deal with the overdue taxes, and now I'm getting notices from the state about child support arrearages. Seems I owe my ex $40,000 now, and because of that amount the state is increasing my payments. I have borrowed and sold everything and have been making payments on or ahead of schedule for the last few years. If I get a job now, they will take out the first $1500 per month out of my paychecks. There aren't any jobs here in the "biz", and I can't leave town yet because of my dads health. Last year I tried working at a couple different factories and they sucked. One was metal plating (I got nosebleeds and headaches from the fumes), the other was assembling boxes (the first day, I did a weeks quota). 40 hour weeks, paychecks for $0.00.....fun stuff
