For tax purpose you are considered married if you were married as of December 31st of that tax year. If your divorced was finalized OR you were LEGALLY separated before December 31st of that year you cannot file a joint return; you must file as single or head of household. Your dad might be a judge and I might only be a student in an Income Tax class but I'm pretty sure the IRS won't let you file as Married Filing Joint for the year you were legally separated and/or your divorce was finalized. Edit: You can certainly change a lot of things in a divorce decree, who can claim a dependent exemption being one of them. This IRS problem is from 2004, the year I was working my ass off and she didn't feel the need to get a job. She even put the kids in day care and afterschool care. I guess she didn't want to be interrupted during her soaps. Oh well, I still get to pay her and her fiance every week (which i do) and I get to claim it on my taxes. It sounds like you have to file Married Filing Separate for 2004 now, which is the worst tax bracket . I've met her new husband last time I got the kids and he seems like a very nice guy. I wanted to warn him, but couldn't get him alone. Now I need to rant: You'll read the (short) story of Rick. Before I started dating my ex, I owned both a Porsche and BMW (yes I'm a car guy) parked in the driveway of my own house. She had an old Cavalier. I'm not sure how it happened but after we married the Porsche and BMW went away and I was driving her old car and we bought a newer BMW for her? Then I had to buy a better house, which made us living paycheck to paycheck. It just sucks that I have to still pay her over 1K a month, I rarely see the kids, and she is living in a very nice house in a gated community in FL, and I am stuck back home living with the parents. I've worked odd jobs here and I get a paycheck showing I worked 40 hours and after support is taken out, my check is for $0.00 I'm working on a deal with my friends in China for a new amusement park. I think I may just relocate there. Rant off: I'm not asking for sympathy, just needed to get some of my thoughts out. I've heard lots of horror stories like this, as well as seen my younger brother go through a couple of bad marriages. That has given me the incentive to never be in any rush to get married. We learn from our mistakes? To hell with that! I like learning from the mistakes of others! It's a lot less costly and painful. I'm not opposed to getting married at some point. One of my best friends gets alimony and she said she won't get married because she loses that payment. A few years ago she bought a home in a new neighborhood with her boyfriend. They live just like an average married couple, but she still takes that payment. What I don't understand is why does the guy always suffer? Luckily my attorney in Evansville was good enough so I didn't have to pay her attorney fees here (50k), but I still had to pay both mine and hers fees in FL. This case cost close to 100k in fees, and I spent time in jail for falling behind in the beginning ($400 a week), all for about 12k in back child support that I was making payments on. I'll be making payments well after the kids turn 18.
