Hitler gets reprieve from YouTube

The Hitler Downfall parody meme has won a stay of execution after YouTube advised its users to fight back against attempts to remove the immensely popular clips from the site.
Earlier this week several of the parodies, created by adding fake subtitles to Hitler's famous rant scene in the 2004 German film, vanished from YouTube. The production company, Constantin Film, argued they infringed its copyright.
The most recent parody is Hitler's supposed reaction to Constantin's decision to remove parodies, but the clips cover topics as broad as the death of Michael Jackson to the recently misplaced iPhone prototype, both of which are available to view on YouTube. Many others, though, now only display a pop-up message saying: "This video contains content from Constantin Film, who has blocked it on copyright grounds."
In order to remove the clips, Constantin is using Content ID, a tool supplied by YouTube to enable them to set different policies depending on the proportion of their content used in a video or the length of the clip.
But in a blog post following the takedown requests, YouTube product manager Shenaz Zack pointed out that the company had made it easier for users to dispute inappropriate Content ID claims.
"If you believe your video is fair use, check the box that reads 'This video uses copyrighted material in a manner that does not require approval of the copyright holder'," Zack wrote.
"Once you've filed your dispute, your video immediately goes back up on YouTube. From this point, the claimant then makes a decision about whether to file a formal DMCA [Digital Millennium Copyright Act] notification, and remove the content from the site according to the process set forth in the DMCA."
The blog post didn't mention the Hitler Downfall debacle by name but linked to one of the parody clips as an example.
Online rights advocates say that fair use provisions in many countries such as the US were created to allow some copyrighted material to be used for purposes such as satire or parody.
Social media blog Mashable argues the Downfall clips are clearly fair use and notes that some of the videos that were taken down have already been restored, including the "Hitler Orders DMCA Takedown" video.
"Oh, and there's one more interesting tidbit: The Downfall takedowns took place on what would have been Hitler's 121st birthday," Mashable reported.
YouTube's Zack said over the past decade the evolution of the internet had altered the landscape for both traditional media companies and the doctrine of fair use, and the media industry had tried to keep up.
"Hundreds of millions of people around the world now use the web to connect and interact with content online, and a huge percentage of them go even further: they express themselves via parodies, celebrate their favorite videos with mashups, and use music in educational presentations," Zack wrote.
"The people that upload these videos are typically the biggest fans, and are exactly the kinds of consumers rights holders should be embracing."
Some commenters on the YouTube blog still weren't happy, clearly outraged at the attempts to remove the Downfall clips.
"The attack on fair use you guys have enacted with Content ID and the Downfall parodies has inspired me," one wrote.
"I'm deleting my YouTube account, and I'll be using AdBlock whenever I use the site to be sure YouTube isn't getting any money from me."
Strangely, the director of the Downfall film, Oliver Hirschbiegel, has been quoted saying that he found the clips "so funny" and that "you couldn't get a better compliment as a director".
